Criminal Defense Law

Texas is known for its tough laws and tougher punishments. Our legislature adds criminal offenses to the penal code on a regular basis with stiff penalties that carry lifelong consequences. The Texas Legislature criminalizes certain conduct that is legal in other states or only amounts to minor infractions. The Criminal Defense lawyers of the Gutheinz Law Firm are committed to advocating the federal and state constitutional rights of an accused from the moment they come into contact with the police.  We will defend you against all criminal chrages in both state or federal courts.

Here are a few of the more unusual laws that Texas has on the books that would require a criminal defense lawyer:

  1. Contributing to Delinquency of Habitual Drunkard or Narcotic Addict.
This is one of the poorest worded statutes on the books, and could get a person in trouble for buying a round of drinks.
  2. Illegal Recruitment of an Athlete.
This “crime” can, under certain circumstances, rank as a first degree felony, comparable to murder, aggravated kidnapping or aggravated robbery.
  3. Mass Picketing.
This “crime” was poorly thought out in light of our First Amendment protections, and is also poorly written.
  4. Terroristic Threat.
It is not always what you think. This statute has been used to charge children for playing the game of hangman.
